1. Purpose
These Terms of Use & Sale ("Terms") govern access to and use of the Quizmify service, published by Marcos Suarez Romero, sole trader (SIRET 897 513 065 00010), as well as the sale of the paid Pro plan. They apply to all users of the Site.
2. Service description
Quizmify allows a user signed in with Google to generate multiple-choice quizzes on a topic of their choice, using an AI model. Questions are generated automatically and may contain errors; Quizmify does not guarantee their accuracy.
3. Plans and pricing
The Free plan is free and allows unlimited play up to level 2 progression. The Pro plan is a one-time payment of $5.99, with no subscription or renewal, granting access to unlimited level progression.
4. Payment
Payment for the Pro plan is processed by Stripe. Quizmify does not collect or store any card data. The account is activated automatically once payment is confirmed by Stripe.
5. Right of withdrawal
Under Article L221-28, 13° of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content not supplied on a physical medium whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. By checking the confirmation box before proceeding to payment, the user acknowledges that access to the Pro service is immediate and expressly waives their right of withdrawal.
6. Refund policy
Regardless of the waiver above, Quizmify offers a voluntary 7-day money-back guarantee from the date of purchase. To use it, contact marcossuarezr88@gmail.com with the email associated with your account.
7. Liability
The service is provided "as is." Quizmify cannot be held liable for errors in AI-generated questions, nor for temporary service interruptions caused by its technical providers (Vercel, Supabase, OpenAI, Stripe, Google).
8. Termination
The user may delete their account at any time from the My Account page. This action is permanent and results in the deletion of all their data (games, answers, progress). Pro status already acquired does not entitle the user to a refund beyond the period mentioned in Section 6.
9. Governing law
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent French courts shall have exclusive jurisdiction.
